One year after the Wilmore City Council approved the R-5 Rural Transitional Zone for Roseglade Farm, the conservation easement was signed and the farm was annexed into the City.
Margaret Graves who is the Executive Director of the Bluegrass Conservancy and also an attorney with experience in drafting conservation easements, worked with City Attorney Bobby Gullette to create the 19 page document designed to protect over 100 acres of Roseglade Farm in perpetuity.
Because of the strategic location of the farm at the main entrance to the City,
and because this was the first conservation easement recorded in the City, special
care was taken to make sure that the document provided the protection necessary
for the property.
The conservation easement insures that this portion of the farm will remain
essentially "green". No development will be allowed in the protected
area except for the construction of a single family dwelling (which could be
a bed and breakfast) and garage, agricultural buildings to replace those now
on the farm, and possibly a golf course or park.
The remainder of the farm is planned to be developed into 131 lots (10,000 square
feet minimum) for single family homes plus 44 townhouse units which will be
clustered around two sides of the three-acre lake on the property. Nearly 11
acres of additional property is reserved as green space to be owned and maintained
by the homeowners association. A part of that is a 1½ acre circle containing
the historic home, now used as an office for Roseglade Farms.
No building is allowed within 200 feet of either US 68 or KY 29.
The conservation easement makes clear that even if part of the protected area is condemned by anyone, including the highway department for the purpose of a creating a new alignment of the US 68 and KY 29 intersection, the remainder of the area covered by the conservation easement remains protected.
